Membership Agreement

Thank you for reviewing the terms ("Terms" or "Rules") for the Reward Club (the "Club"). These Terms are between Reward Club Members ("Members") and Cross.com. and/or its affiliates ("Cross”), and govern our respective rights and obligations. Your participation in the Club is subject to our Terms of Use and Privacy Policy, as well as all other applicable terms, conditions, limitations and requirements. The Terms, together with applicable terms related to any promotional offers provided to you for use with the Club, constitute the entire agreement between You and Cross related to the Club. By enrolling, and continuing to use the Club, you accept these terms, conditions, limitations and requirements. We may make changes to these Terms or Terminate the Club. In the event Cross makes material changes or terminates the Club, we will notify you by e-mail and/or post the new terms at https://www.cross.com/.

Subject to these terms and conditions, Members will earn Rewards Points (“Points”) in connection with the purchase of qualifying products athttps://www.cross.com/ and may additionally be awarded points for participation in shares and surveys.

I. MEMBERSHIP

1. Free Membership.

No purchase is necessary to earn Points in the Club. To earn points, simply register an account onhttps://www.cross.com/

2. Eligibility.

You must be an individual age 18 years or older and a resident of the United States or Canada to be eligible for membership. Membership in the Club is limited to individuals only and is limited to one account per individual. By joining the Club, you agree to be bound by these terms and conditions. To enroll in the Cross Rewards Club you must create an account on www.Cross.com and provide your first name, last name, gender, email address, and date of birth. Each person may have only one Member account.

3. Opening an Account.

You may register to become a member of the Program by visiting https://www.cross.com/ and creating an account on our website..

 4. Account Maintenance.

Once you are a Member, you may view a summary of your Account on the website. After logging onto the website, simply click on the "My Account" link in the header of the website to change any information on your account. You may also view your rewards points balance, transaction history and eligibility for bonus offers on the website by logging in and clicking on the "Reward Points" link in the profile navigation.

5. Member Cancellation.

You may cancel your Club membership at any time by canceling/deleting your website account. Upon cancellation, any unused points accrued in your account will be forfeited and cannot be redeemed.

II. EARNING POINTS

1. General.

Members can earn points on the online purchase of any products and/or participation in online shares/surveys at https://www.cross.com/. To earn points, you must be a Rewards Club Member. You must be signed into your Member account to receive Points for any purchase made. 

2. Earning Points.

Members earn one (1) point for every $1 spent on any online purchase at https://www.cross.com/. Each 500 points earns $25 credit towards any Cross Pensbrand product. You may start redeeming your reward points once you have earned 500 points. Points cannot be shared with any other Member.

  • Get 1 point for every $1 spent on https://www.cross.com/.
  • When 500 points are earned, you will beable to utilize your points to pay for product purchases on our website.  

3. Timing of the Addition of Points to Accounts.

Points earned from the purchase of qualifying products will be credited within 24 hours after shipping. The timing for issuing points is subject to change.

4. Returns.

Points earned for a purchase that is then the subject of a return, refund, returned check due to non-sufficient funds, or other credit issue will be deducted from the Member's account in an amount equal to the points earned for the original transaction, including any bonus points. If a return will cause your Rewards account to have a negative point balance, a store credit will be issued for the cost of the item being returned regardless of your original form of payment.

5. Bonus Point Promotions.

From time to time, Cross may run certain bonus point promotions. Under bonus point promotions, Members can earn additional or "bonus points" in connection with the purchase of certain products. When these products are purchased on Cross.com by a Member, the Member will earn bonus points on each product, as specified in the offer. Bonus point promotions are subject to the terms and conditions of the offer and may be offered at any time in Our sole discretion. Bonus point offers cannot be combined with any other offer.  You may also earn additional points on non-purchase activities as offered by Cross at our sole discretion. From time to time, Cross may offer the chance to win various prizes, including points. There is NO PURCHASE NECESSARY TO PLAY OR TO WIN. Rules and restrictions will apply to such promotions.

6.  Points Disputes.  If you believe that a purchase made on your Reward Member account should have resulted in the addition of points to your points balance, and such points are not reflected in the Points balance of your account within twenty-four (24) hours from the date the item(s) have been shipped, notify us immediately. We will use reasonable efforts to investigate your Points Dispute so long as You notify us of a dispute within ninety (90) days of the posting date of the purchase. If you do not notify us within the ninety (90)-day period, you will have waived your right to make a Points Dispute with respect to that purchase. Written notice of the dispute is required to be received within [14 days] of the date of purchase in order for Cross to undertake an investigation.  Notices may be   sent via email to customerservice@cross.com   Cross shall make reasonable effort to complete any Points Dispute investigation with 14 days from receipt of notice.  Any decisions resulting from a Points Dispute investigation will be final; Cross will have no further responsibilities in the event a Points Dispute is reasserted at some future date.

III. REDEEMING POINTS

Points may be redeemed for products as follows:

            500 Points:  $25 credit towards any Cross brand product.

Points may only be redeemed once you have accumulatived 500 points.

The Club Members are responsible for sales tax and shipping and handling on all products purchased with redeemed points.

Points accumulated on different Reward Program accounts may not be combined or aggregated. Points earned in a transaction cannot be redeemed in the same transaction.

IV. GENERAL

Cross may, in its sole and absolute discretion, change the Club Terms and Conditions at any time, including, without limitation, the point conversion ratio, the point expiration policy, the website Terms and Conditions or Privacy Policy, or any aspect of Program membership. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

A Member's point balance, as reflected in our records, shall be deemed correct, unless and until Cross receives notice of a Points Dispute as herein described. 

We assume no responsibility for errors caused by incorrect Member information.

The sale of points is prohibited and may result in the confiscation or cancellation of the Member's points as well as suspension or termination of Membership, which in each case shall be final and conclusive.

Cross reserves the right to revoke any Program membership at any time if the Member engages in abuse of the Program or fails to follow the Terms and Conditions of the Program. Fraud or abuse relating to the accrual of Points or redemption of rewards may result in revocation of membership in the Program.

Points are non-transferable and cannot be redeemed for cash.

The interpretation and application of the Program's Terms and Conditions shall be at the sole discretion and determination of Cross.

V.  Limitation of Liability


IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN THE WEBSITE'S TERMS AND CONDITIONS, IN NO EVENT WILL CROSS OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO THE PROGRAM. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE TOTAL AMOUNT OF THE QUALIFYING PURCHASE THAT IS THE SUBJECT OF THE DISPUTE. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF PROGRAM MEMBERSHIP. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT LIMIT OR EXCLUDE LIABILITY FOR CROSS'S GROSS NEGLIGENCE, INTENTIONAL, WILLFUL, RECKLESS, OR MALICIOUS MISCONDUCT, OR FRAUD.

VI. Dispute Resolution

Cross and Member each agree that any dispute resolution proceedings of any nature or in any forum will be conducted only on an individual basis and not in a class, consolidated or representative action. This means that Members may not purport to act on behalf of a class or any other person. Likewise, an arbitrator may not consolidate more than one Member's claims, and may not otherwise preside over any form of a representative or class proceeding.

Cross and Member each waive any right to a jury trial, unless such waiver is unenforceable. This means that any claim would be decided by a judge, not a jury.

Cross and Member agree that Cross may bring suit in court to seek to enjoin infringement or other misuse of intellectual property rights.

VII.  Governing Law

THESE TERMS AND CONDITIONS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF RHODE ISLAND WITHOUT REGARD TO ITS CONFLICTS OF LAWS PRINCIPLES.  ANY DISPUTES OR CLAIMS ARISING OUT OF OR RELATING TO MEMBER SHALLBE SUBMITTED TO THE JURISDICTION OF THE COURTS OF THE STATE OF RHODE ISLAND IN PROVIDENCE, RHODE ISLAND, USA.
